Conditions of Sale
All orders accepted and supplied by ROSTO Pty Ltd. are governed by the following Conditions of Sale. They apply to the exclusion of all other conditions. By placing an order, you acknowledge that you have read, understood and accepted the Conditions of Sale.

By using this website, you also accept and agree to be bound by our Terms of Use and Privacy Policy. ROSTO Pty Ltd. invites you to read them carefully before using the services provided on this website.

ROSTO Pty Ltd. reserves the right, at any time, to modify the Conditions of Sale by posting a new dated version on this website. By placing an order after ROSTO Pty Ltd. has posted a new version of the Conditions of Sale, you agree to be bound by that updated version.

Orders
By placing an order through this website, you make an offer to purchase the products you have selected under these Conditions of Sale. Orders you place with ROSTO Pty Ltd. on this website are subject to minimum and maximum quantity limitations. ROSTO Pty Ltd. offers its products on this website within the limits of its available stocks.

Order Confirmation
The orders you place with ROSTO Pty Ltd. will not constitute a binding contract unless and until ROSTO Pty Ltd. accepts and confirms receipt of your order.

ROSTO Pty Ltd. reserves the right to refuse orders for any reason.

Prices
The prices payable for the items you order are those displayed on this website on the date you place your order. Delivery charges will be charged at the rates indicated on this website on the date you place your order. ROSTO Pty Ltd. reserves the right to modify its prices and delivery charges at any time and to cancel a contract in case of writing, printing or calculation errors.

GST
All prices quoted are inclusive of GST.

Delivery
All orders confirmed by ROSTO Pty Ltd. will be delivered to the delivery address you specify when placing your order. ROSTO Pty Ltd. does its utmost to ensure deliveries within three – ten working days after your approved purchase however, delivery to regional areas may take longer.

Deliveries can only be made within Australia.

Risk and Title
Risk in the goods passes to you on delivery. Property in the goods remains with ROSTO Pty Ltd. until payment in full has been received by ROSTO Pty Ltd. If payment in full is not made in accordance with ROSTO Pty Ltd.’s Conditions of Sale, ROSTO Pty Ltd. may require you to return the goods immediately at your expense.

Merchandise Verification
It is your responsibility to verify the quantity and condition of the merchandise upon delivery. In case you observe damage or missing items, you must provide written notice of damage or missing items to ROSTO Pty Ltd. within five working days after the delivery. ROSTO Pty Ltd. shall in such a case provide you with identical replacement merchandise. If no written notice is received by ROSTO Pty Ltd. the goods shall be deemed accepted by you.

Returned Goods
Where goods are rejected by you as not being in accordance with your order, ROSTO Pty Ltd.  will only accept the return of goods provided that it receives written notice within five working days of receipt of the goods by you. If no notice is received, the goods shall be deemed to have been accepted by you.

Returned goods will not be accepted without a return authorisation number which will be supplied by ROSTO Pty Ltd. on receipt of written notice by you.

Where ROSTO Pty Ltd.  has supplied goods in accordance with your order, ROSTO Pty Ltd. will accept the return of those goods subject to payment by you covering the cost of freight both ways. You must quote the invoice number that the goods were supplied under. The goods must be in the same condition they were in when despatched by ROSTO Pty Ltd. to you. If you comply with these conditions, ROSTO Pty Ltd. will provide you with a full refund for the cost of the goods only.

Payment
Payment for goods is by credit card (Master Card and Visa), cheque and money order only.

Limitation of Liability
Without limiting the scope of these Conditions of Sale, no claim of any kind, whether as to products delivered or non-delivery of products, or otherwise, shall be greater in amount than the purchase price of the products in respect of which damages are claimed. In no event shall ROSTO Pty Ltd. be liable for any indirect, incidental or consequential damages of any nature (even if the advent of such damage was known or could have been known by ROSTO Pty Ltd.), capable of arising in connection with its products, their use, sale or this website.
 
Force Majeure
ROSTO Pty Ltd will make every reasonable effort to fulfil its obligations. However, ROSTO Pty Ltd cannot be held responsible for delays or failure to deliver caused by circumstances beyond its reasonable control. Such circumstances include strikes, wars, natural catastrophes or any others that make impracticable the production, transportation or delivery of products. In the event of delay, ROSTO Pty Ltd will perform its obligations as soon as reasonably possible, and it reserves the right to allocate any remaining product supply among customers in a fair and reasonable manner.
